Privacy Policy Notice

DULY CARE (“Duly Care”) (“We” or “Our” or “Us”) respects the privacy of individuals, including individuals like you who browse, use, or purchase products and/or services (hereinafter referred to as “You”/”Your”/”User”) through our website/ mobile application www.dulycare.in (herein referred to as the “Site”). This Privacy Policy Notice explains how We process Your Personal Data (defined in the next section) when You visit or use Our Site.


We encourage You to periodically review this Privacy Policy Notice, to stay informed of updates available on the Site. Once you click “I Agree” below it will mean that You have consented to the processing of Your Personal Data in the manner as described in this Privacy Policy Notice. 
You have the option not to provide Us the consent with Your Personal Data that is sought to be processed by Us. You will also have the option to withdraw Your consent at any time by intimating Us in writing.   Please note that if You do not provide Us Your consent to process Your Personal Data or if You withdraw Your consent at any time, We may not be able to fulfill the purposes for which the said Personal Data was sought and We may restrict You from using the Site or Our services or any part thereof.


1.    Definitions
This clause provides the definition and meaning of various concepts used in the Privacy Policy Notice.


Personal Data: Any data about You that helps Us identify You or is in relation to You and can include Your financial data, health data, etc. The Personal Data that will be processed by Us is specified in Para 2 of this Notice.


Processing (including its grammatical variations): Processing in relation to Your Personal Data means performing any automated operations including collection, recording, organising, structuring, indexing, sharing, storage, and adaptation, and would also include analytics done by Us to provide You with Site-related services. 


Specific Purpose: This means the particular reason or purpose for which We collect Your Data.


Personal Data Breach: This means any unauthorised processing of personal data or accidental disclosure, acquisition, sharing, use, alteration, destruction or loss of access to personal data, that compromises the confidentiality, integrity or availability of personal data.

We will collect and process the following types of Personal Data:
a.    User’s name,
b.    Birth date/age,
c.    Blood group,
d.    Gender,
e.    Address (including country and pin/postal code),
f.    Location information, including Your GPS location,
g.    Phone number/mobile number,
h.    Email address,
i.    Physical, physiological, and mental health condition, provided by You/User or accessible from Your/User’s medical records,
j.    Personal medical records and history,
k.    Valid financial information at the time of purchase of product/services and/or online payment,
l.    Duly Care Login ID and password,
m.    User details as provided at the time of registration or thereafter,
n.    Records of interaction with Duly Care representatives,
o.    Your usage details such as time, frequency, duration and pattern of use, features used, and the amount of storage used,
p.    Master and transaction data and other data stored in Your user account,
q.    Internet Protocol address, browser type, browser language, referring URL, files accessed, errors generated, time zone, operating system, and other visitor details collected in Our log files,
r.    User’s tracking Information such as, but not limited to the device ID, Google Advertising ID, and Android ID,  
s.    Any other information that is willingly shared by You.


3.    Specific Purpose of Collection and Use of Collected Data 
Your Personal Data that is collected by Us or on Our behalf will be processed for the following Specific Purposes:
a)    To process requests and orders for products and services, provide details about Your orders; 
b)    To share with our service providers for providing products and services to You;
c)    To conduct study, research, and analysis in order to operate and improve the Site; 
d)    To promote, advertise, and offer for sale goods, products, and services;
e)    To improve Our business practices, our Site designs, and Your experience on our Site;
f)    To build Your profile, assess Your requirements, queries, complaints and feedback; 
g)    Where such processing is necessary for merger or demerger, security announcements, billing, pricing and administration; 
h)    To share with the business partners for purposes necessary to provide access to Our Site and Our services;
i)    To exercise legal action, investigate, prevent, or take action regarding illegal activities, suspected fraud, and violations;
j)    To share with statutory authorities, government institutions, or other bodies for compliance with legal requirements; 
k)    To conduct Processing that is necessary to fulfill contractual obligations. 


4.    Changes In Your Personal Data

Please note that You will always have the option to review the Personal Data as provided by You to Us.  


If You desire to delete, make any change, or correct Your Personal Data, You may put a request to Us in the manner described in Paragraph 12 of the Privacy Policy Notice. 


We do not assume any responsibility for the accuracy of Your Personal Data or to keep Your Personal data up to date.


5.    Disclosure to Individuals and Third Parties
We may share and disclose Your Personal Data with individuals and with other entities who work for Us for the Specific Purposes outlined above. Please note that we do not share Your Personal Data with third parties without Your consent. Once You consent to this Privacy Policy Notice, You agree to share Your Personal Data with third parties. 


6.    Cookies 
We may use cookies, web beacons, web crawlers, tracking pixels, and other tracking technologies on the Site in order to help us customize the Site and enhance Your experience. When You access the Site, Your personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies but be aware that rejecting cookies could affect the availability and functionality of the Site. You may not decline web beacons. However, they can be rendered ineffective by declining all cookies or by modifying Your web browser’s settings to notify You each time a cookie is tendered, permitting You to accept or decline cookies on an individual basis. By using the Site, You agree to accept the Cookies. 


7.    Minors
Our Site does not offer products and services for children/minors. If You are below the age of 18 years,  You accept that You will access and use Our Site only under the supervision of a parent or guardian. The consent required under this Privacy Policy Notice must be given by a parent or lawful guardian in the case of access or use of the Site by minors.


8.    Data Protection 
We implement reasonable physical, technical, and administrative security measures to prevent Personal Data breaches. However, no security measure is completely foolproof.


9.     Declarations
a.    You acknowledge that You are providing Your Personal Data in a free, informed, and unconditional manner. Where You are providing information for someone else, You hereby confirm that You are authorised to provide such information to Us.  
b.    Further, You hereby acknowledge that the collection/receipt of Your Personal Data by Duly Care is necessary for the Specific Purposes identified hereunder. 
c.    You hereby consent that the collection and processing of any Personal Information, if it is done in accordance with the provisions of this Privacy Policy Notice, shall not cause any wrongful loss to you.


10.    Data Retention
We will retain Your Personal Data for as long as necessary for meeting the Specified Purposes, for other essential purposes such as resolving disputes if any, for complying with our internal procedures, for enforcing our policies, and where applicable, We may retain Your Personal Data for longer period of time than is necessary for reasons indicated above, if such retention is expressly mandated or necessary to comply with any obligations under applicable laws. 


11.    Complaints
If You have questions, complaints, or comments about this Privacy Policy Notice or any action is required in relation to your Personal Data including withdrawal of consent, change, correction, or deletion, please contact the Grievance Officer athello@dulycare.in. You can also make a complaint to the Data Protection Board of India in case the Grievance Officer is unable to resolve Your grievance to Your satisfaction.
